Appellate rules are complex in Oregon

On Behalf of | Dec 4, 2015 | Civil Appeals |

Did you know that the rules published by the Oregon Court of Appeals to govern how appeals are entered and argued take up over 200 pages of text? The rules are known as the Oregon Rules of Appellate Procedure, or ORAP, and they can be amended at any time by the Oregon Court of Appeals.

This comprehensive and complex set of rules governs cases heard by both the appellate courts and the Oregon Supreme Court. The document of rules covers filing fees and deadlines, rules for filing documents electronically, the proper format for all filings and procedures for arguing orally before the court. Other items covered by ORAP include procedures for how the court of appeals might review trial court decisions and procedures for a review of appellate decisions at the supreme court level.

Among other things, the rules detail how appeals notices are handled, how transcripts and exhibits are handled and returned and what information might be included in a judicial review of various types of cases. Cases are broken into types, such as administrative agency proceedings and land use decisions..

Failure to follow the rules outlined for motions and petitions or any other aspect of an appeal can result in the loss of an appeal even if your argument is otherwise valid. Details become critically important at the appellate level, which means an understanding of the law and the lengthy rules governing appeals is essential to success.
